Terms of Service

1. Service Description

What's Booked ("the Service") is a software-as-a-service platform that provides AI-assisted appointment booking, customer communication, email management, and business automation tools for local service businesses. The Service is operated by What's Booked.

2. Account Registration

To use What's Booked, you must create an account providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Send unsolicited commercial messages (spam) through the Service
  • Attempt to access other users' data or accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to store or transmit malicious code
  • Resell or redistribute the Service without authorization
  • Use AI-generated content to impersonate individuals or mislead customers

4. Data Processing

By using What's Booked, you acknowledge that customer data entered into the platform may be processed by AI systems for the purposes described in our Privacy Policy. As a business using What's Booked to process your customers' data, you act as a data controller and are responsible for:

  • Obtaining appropriate consent or legal basis for processing your customers' personal data
  • Informing your customers about the use of AI in communications
  • Responding to data subject requests from your customers
  • Ensuring the accuracy of data entered into the Service

5. Intellectual Property

The Service, including its software, design, and documentation, is owned by What's Booked and protected by intellectual property laws. You retain ownership of all data you input into the Service. You grant us a limited license to process your data solely for the purpose of providing the Service.

6. Limitation of Liability

To the maximum extent permitted by law, What's Booked shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for direct damages shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

AI-generated content (email drafts, reminders, chat responses) is provided as suggestions. You are responsible for reviewing and approving all AI-generated communications before they are sent to your customers. What's Booked is not liable for the content of AI-generated messages that are sent without review.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice for planned maintenance when possible.

8. Termination

You may terminate your account at any time through the account settings. Upon termination:

  • All your data will be permanently deleted (see our Privacy Policy for retention details)
  • Any outstanding fees become immediately payable
  • Your access to the Service will be revoked

We may suspend or terminate your account for violation of these terms with reasonable notice, except in cases of severe abuse where immediate action is required.

9. Changes to Terms

We may modify these terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified terms.

10. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany, unless mandatory consumer protection provisions require otherwise.
